capital improvement and rent increases

Our landlord is renovating our building to create 2 full renovated apartments
and we are currently living in half the space leased to us while the renovation
occurs; we are the only occupants now. In verbal agreement, the new renovated
space would be rented to us at the same rent, we did not sign an
agreement (studpidly) and I think we're on month-to-month basis now b/c I can't
find a copy of the current lease (we've been there for 3 years.) Now the contractor
bid is higher than the landlord expected so now he is making it our problem by
violating our agreement by telling us the rent will be higher. What rights do
we have being on a month-to-month basis? Should put our rent in current in escrow?
If so, how to? This really messy situation has been created, partially by
not taking the proper steps ... what should we do NOW?
