Assuming that you received a three-demand for rent from the processor server on September 28th, payment on Ocober 4th would technically be late. The last day to pay on time would have been October 1st.
However, your lease may require more than three-days' notice, and the rent demand may not have been served properly by the procees server. Finally, the landlord's attorney might not rush to court first thing Monday morning, October 4th, to get an index number.
Even if you are served with court papers, you still have the right to pay the rent due, although there may be court costs, late fees, and attorneys' fees.
