Sewer

I am from New York and I am renting a basement (of a 2 family house)
without a written lease (because the landloard refuse to
issue me one.

My questions are:

1) Is a landload allow to rent out its basement?
2) If there is a sewer problem and the whole house is flooded with toilet water, would it be the
landlord's responsibility to fix the problem and pay for the damage? For example,
will he be responsible to pay for the new rug if the old one is soaked with toilet water?
