The borough office of the Department of Buildings is the place to go to check the certificate of occupancy.

If the apartment is illegal, you are not required to pay rent, but the landlord will eventually be able to evict you. You should look at the web page which Mark Smith has been posting from the Queens borough president's office. The rules are the same in Brooklyn as they are in Queens.
