Answers to all of Joann's Questions about Illegal Apartment

Posted by Mark Smith on September 10, 1999 at 18:26:27:

The fact that there isn't a separate electric meter is a strong indication that Joann's basement apartment is illegal.

The Queens Borough President has an excellent webpage about Joann's situation, Illegal Apartment Conversions: A Guide to the Law and Enforcement Procedures, which you can find at:

http://www.queens.nyc.ny.us/presiden/convert.htm

or click on the link below

There is one error in the last paragraph: to bring the case in Civil Court/Housing Court, the assessed valuation of the building -- not the real estate taxes -- must be less than $25,000 [New York City Civil Court Act 203(j)].

Joann is entitled to a rent receipt [Real Property Law 235-e and Housing Maintenance Code 27-2105]. And not only can Joann's boyfriend stay overnight, he can move in with her [Real Property Law 235-f].
