Answers to all of Joann's Questions about Illegal Apartment

The fact that there isn't a separate electric meter is a strong indication that Joann's basement apartment is illegal.

There is one error in the last paragraph: to bring the case in Civil Court/Housing Court, the assessed valuation of the building -- not the real estate taxes -- must be less than $25,000 [New York City Civil Court Act §203(j)].

Joann is entitled to a rent receipt [Real Property Law §235-e and Housing Maintenance Code §27-2105]. And not only can Joann's boyfriend stay overnight, he can move in with her [Real Property Law §235-f].
