: One tenant in our rent-stabilized building (NYC) is being transfered upstate by his company.
: He contacted the LL about breaking the lease w/o penalties.
: The LL asked him to sign a document "giving up all rights to the security deposit and all rights and claims he has under the lease" against the LL; then he will be released from the lease obligations.
: We have a number of cases pending against the LL at DHCR, including rent overcharges, reduction in services, and appealing MCI charges.
: Should the tenant sign the document?

????????????????
NO. 1000% NO. he would be giving up his share of the MCI refund, O/C refund, and his security deposit?!? he should arrange a sublet (read how here) and if the LL says no to that, the LL will owe him his security deposit.

ps: why doesn't he take the givaway papers to the lawyer you all use for all that other stuff?
