Usually a lease only becomes valid if you take possession of the appartment within a certain number of days from signing. If you never take possession of the apartment the lease is terminated.

This is usually the case here in NY. Some states have a grace period where the renter can back out legally. I'm not sure what the laws are in your might want to try going to's main page at and lookup your state...

How did you pay this deposit? cash check? did you get a receipt? I would consider calling your States attorney general to ask some questions.

: hello
: i hope i didn't make the biggest mistake of my life today. i have been looking
: for an apartment to rent for my fiance and i. had 2 narrowed down to look at. i
: could not get a response from my #1 choice(no answer). fearing that it was
: taken, i looked at the #2 apartment. it wasn't as nice as the first, but
: apartments are hard to find in minneapolis this time of year. i signed a 1yr
: lease, paid a $180 deposit+$20 appl. fee. the lease also needed to be signed by
: my fiance(is out of state right now) so i didn't get a copy of it. at the time
: signing, i informed the management that i was still under consideration on
: apartment #1 and that i would let them know by 10am the next morning if
: i would take it. they he-hawed but agreed that would be ok. an hour later
: apartment #1 called me back and i looked at it & signed their lease, still
: thinking that the management of apt#2 would be considerate and let me out&give
: me back the money. i didn't get a copy of the lease, i believe it was for
: 9/1/99 to 8/31/00. immediately after signing the lease for the #1 apt & paying
: $725 deposit, i drove to apt #2 and informed the management that the other
: apt. was a go and i wouldn't need theirs. they said they'd already spent my
: money and it was gone, for holding the apt for 2 hours. i don't remember what
: the particulars were in the lease for breaking it, it seemed they understood
: my situation at the time of signing. now they became evil. can a lease be
: terminated verbally? i didn't sign anything to terminate it. is the lease valid
: even if i was not given a copy? the deposit is the least of my worries. i can't
: afford two apts. today was aug 10, he still has 20 days to find another sucker.
: it sounds like i just lost the deposit but i don't know. my home is 250 miles
: away from mpls and its a chore to go down there all the time.
: please help me
