Security Deposite and rent dispute

Posted by Distressed42 on August 02, 1999 at 09:21:50:

I am moving out in two weeks from my apartment, and I believe that
I should only have to pay for the half of the month that I'm going to be
living there. I gave my landlord 1 month written notice when he only asked
for two weeks. Now he wants me to pay him the whole month's rent and collect
the difference from the new tennant. I live in PA. Also, he refuses to return
my security deposite on the ground that he doesn't want to 'pay it out of his
own pocket'. I was under the impression that he was required to put it in a
passbook savings account and return it to me upon my lease termination. He also
wants me to collect the security deposite from the new tennant. I am on a lease
with another tennant that states that each of us is only resonsible for half of
the rent. We each signed it with that understanding, and I'm the only one
moving out. My landlord refuses to take a quarter instead of a half of the
month's rent dispite the fact that I will only be there for a half of a month.
I am deeply distressed by this because I'm already packing to move to my new
apartment in preperation for college at a new campus.
I believe I am being mistreated and am not sure if I am completely in my rights
to ask for my security deposite back and request only to pay half of the month's
rent. Any help and advice is greatly appriciated. Thank you.
