Assuming that everyting is alright with the apartment and the rent is paid, your fiancee is entitled to the return of her security deposit. However, the landlord can terminate her tenancy without any reason. In New York, this can be on one-month/30-days' notice, coinciding with the rental period (to terminate effective August 31st, the landlord would have to give notice by July 31st or August 1st).
