Breaking the lease

Due to taking up a new job in a different city, I want to break
the lease which expires on September 30, 1999. The landlord
sent a letter that the rent must be paid until the unit is
rented out or until the lease expires whichever comes first.
They have 1.5 months of security deposit, and the maintenance person said that there're people in the waiting list. Because we
are gonna sign the lease in the new apartment in the new city, I can't pay rent in both of these places and would like to
break up the lease immediately. If the landlord rents out the unit within the next month or two, what're the chances that they would go to the rental court?
