Last week's decisions are out: here's a quote for FDCPA watchers:
Dearie v. Hunter is a similar case where Judge Ruben Martino vacated a stipulation with a judgment, and dismissed the non-payment petition on grounds that it violated the FDCPA.
That case was appealled by the landlord and was argued in the Appellate Term for the May, 1999 term. Dearie v. Hunter will be the Appellate Term's first opportunity to hear an FDCPA case coming from Housing Court, and therefore the decision will be particular important.

Question: when LL violates the FDCPA, s/he also violates similar NYC Rules: has anyone brought that subject up in defense? and are they online anywhere other than in summary version Rule 5-77 below?
