Community gardens news: NY Law Journal 5/12

Southern District Judge Allen G. Schwartz yesterday delayed a ruling on a challenge to New York City's plan to sell 115 community gardens until 4 p.m. Wed, saying he wanted both sides to try to resolve the issue on their own. The City recently decided to sell the properties, where gardens have flourished as residents took over deteriorating lots, to the highest bidder, regardless of each buyer's planned use for the plot. A coalition of environmental groups filed lawsuits to block the auction,
claiming the City was discriminating against its non-white residents by eliminating the open space provided by the gardens, which lie predominantly in non-white neighborhoods.
