Collection for Major Capital Improvement

Our LL recently won a partial victory in a multi-year fight regarding Major Capital Improvements in the building. Now he's trying to collect the accrued amount of the increase all at once. I thought LLs were only allowed to charge 6% of the rent per year towards MCI increases, and that they couldn't collect the amount accrued during legal procedings. Anyone know about this? Thanks.
