maybe in legal technicality habitibility isn't reduced. But I would have to think that not being permitted to use an AC during summer months might be grounds for habitibility reduction....the person would have to document the level of heat in the apartment....if its 90 in the apartment in can be severe health hazard...depends on how hot the apartment gets..
Since NYC does have season it would stand to reason that habitibility requirements vary from season to season...anybody know?
