I'm pretty sure if both are on the lease, both are equally entitled to the apartment. I doubt there is any legal way for one to gain possession over the other.

It sounds like either you'll have a permanent Mexican standoff, or one roomate will buy out the other.

: Situation: Roommate A and Roommate B have shared a rent stabilized apartment for 20 years. Both names are on the lease. Now each roommate wants the apartment for himself because each is getting married. Roommate A was the one who found the apartment. Does Roommate A have the right to kick out Rooommate B? If so, what are the procedures? Also, if Roommate A wants to come to some sort of settlement with Rooommate B, what would be equitable? Please advise.
