Repainting before move-in...

NYC, Manhattan, unregulated apartment...

A future landlady is holding out on repainting her apartment even though
it has been three years since she last did so. Isn't she obliged under
current NY law to repaint? Should I wait until the new lease is signed to
get her to repaint it? Can she use her refusal to repaint as a reason
not to rent to me, even though we have a verbal agreement to do so and have
filled out all the preliminary paperwork except for the lease?
