I read somewhere on this board or in the case acrchives that landlords when confronted with the fact that they have not filed appropriate papers...will be permitted to file papers that are backdated to "correct the problem". About up to 2 years back. Also DHCR has placed a 3 or 4 year limit to claim overcharge...so if you miss that window the landlord owes you nothing and the rent stays as is. Thus putting the onus on tenants to find out about overcharges as soon as possible.

If I'm wrong about any of this could someone let me know....
