BUT Here is another very important point:

In MY case when you NEED discovery of the Landlord's documents, PAY the $170 filing fee to file in Supreme Court and then if they
counter sue you in Housing court then you can use the documents there.

We did go to Housing Court today and they finally set a trial date of April 20....
