: Loudrich has made an excellent case for not filing an overcharge complaint with DHCR. He also makes a good case for staying out of housing court in rent overcharge situations by not withholding rent.

: However, he is not fully correct when he says that the only other alternative is to bring a case in New York State Supreme Court. Unless the amount of the overcharge (even trebled) is more than $25,000, the case should be brought in New York City Civil Court.
