I live with my wife and two children in an apartment in a five family building (not rent controlled or stablz'd) in Brooklyn. We've lived here for almost ten years and although we started off with a one year lease, we've only received a new one every few years - the last lease ended in 1996. We've always paid our rent on time and have also paid rent increases when asked (every other year or so).
A month or two ago we (and the other four families in the building) received a letter from the landlords informing us that the rent would increase in Jan by $150 per month (a higher percentage than usual). Although we're not too happy about it, we're willing to pay the increase but would also like to receive a new lease which would give us the assurance of having another year in the building without any further increases or other hassles.
Questions:
1 What rights do we currently have?
2 Are the terms of our most recent lease still in effect since the landlords have been accepting our rent checks, or are we currently living "month to month"?
3 What rights do we have to demand a new lease stating the new rent?
