In New York State, landlords have to give 30 days notice for month to month tenants to vacate. There may be some different laws downstate, so you'll have to check. And just a suggestion, if you think you may not get your deposit back, DO NOT PAY JANUARY'S RENT. As far as eviction goes, that's pretty risky. You're better off finding a new place, and using your security deposit for your last month's rent.
