No deposit return; lost thousands of dollars; help!

Posted by Benny on December 18, 1998 at 03:13:58:

Can anybody help?

My girlfriend and I rent a room in a 3 bedroom apt.
from a roommate who signed the lease with the rental office.
The apt is in Newport, Jersey City. When we move in,
we had no lease but an oral agreement that we can live as long as we want,
at least until May, 1998 coz my gf is an NYU student and she won't be able
to graduate until then.

On 11/21/98 my landlord/roommate knocked on my door and told us to
get out before Christmas. At that time, we knew we probably wouldn't
have to move out until she got a court order. But, after 11/21,
she began to harass us, for example, she asked
friends to party in the livingroom almost every night.
We couldn't stand this since
we were preparing the finals...we moved out on 12/08 anyway.

She failed the return our deposit until now.
We didn't pay the rent of Dec. and the utility bill of Nov.( which hadn't
arrive until we moved out). Plus, according to the landlord/tenant law,
we know we may be able to sue her for any incidental loss???
Though we don't have a written lease, we do possess next year's rent
estimate for our room written by her!

Since we have moved to Manhatten, can we sue her in an NYC court
instead of an NJ court? She's also an NYU student,
she uses an NYC bank, she has nothing to do with NJ except living there!

Thank you very very much!!!

PS. When I rented the room from her, she told me she's an NYU student
but she took no course in that semester and did nothing except
fooling around. Is this a fraud? Since she's a Taiwanese and
if she doesn't study, she'll be deported, which would've been
a major concern if I has been able to know this.
