DHCR Overcharge Case

I am in an overcharge case with my landlord. This case has been going on
for 14 years. In effect my building is rent stabilized and I won a ruling from DHCR that I was being overcharged by the landlord and I won the case and had my rent reduced. But in addition I am owed back rent money from the landlord. The landlord contested the case (PAR) and it took DHCR about 10 years to rule on that case and in July of 1998 I was told I won that case too. Now the case is headed to Supreme Court to get the final judgement on whether I get the money and DHCR says that it lost the files of past rental history for my apartment. A lawyer I was referred to said that now I could lose the case. Something sounds fishy to me. Couldn't DHCR be sued for losing files instrumental in this case. A lawyer told me that now I could lose the case to the landlord and in such a case that I will owe the landlord back rent. Are there anyone out there who has had things happen to them like this.
