: I don't know if this is really a landlord/tenant question or a domestic one. A relative of mine in Brooklyn has an unemployed deadbeat boyfriend who has been living in her apartment and mooching off of her for years. She wants to know if she can throw him out. She is on the lease; he is not. There is no written agreement between them. She has asked him to move out but he won't -- he claims she's crazy and he's worried about her. How can she kick him out? (He is verbally abusive but hasn't used physical force.) Alternatively, can she move out without liability to the landlord? I don't know if her lease is month to month or longer. She really is about to go over the deep end on this, so I would appreciate any help.

No, she can't just throw him out. As a "roommate" she needs to commence
a licensee proceeding in Housing Court as if she is the LL and he's the
tenant. Only a judge can evict. But get the LL on her side to cooperate.
