An illegal apartment is just that illegal... Do you want to move out?
I assume you either signed an agreement with the landlord or moved in as a month to month tenant. In either case you will not be able to recover any rent. In fact you would cause your own eviction. If the place is liveable then stay and plan for your future. A place of your own. If it is not livable then move. You have No rights as a tenant. Once you file a complaint eviction papers will soon to follow. Your complaint will be meaningless. sorry.

: We are renting out of a privately owned house in Westchester County. I just had a thought that the premises may not be legally approved for this use. Can I bring legal action to this situation and recover rent? If it is illegal, won't we be evicted?
: Please advise.
: Thanks!
