Non-Primary Residence Issue in Rent-Stable apt

Posted by Victoria on September 29, 1998 at 17:21:08:

Hi,

Two questions:

The leaseholder of my apt moved out to go to school in another state. The landlord has questioned whether her NY apt is still her primary residence. Are there exceptions for students?
Also, the landlords have said that if she is unable to prove that her primary residence is in NY, they will not let her renew the lease. Will the landlord be obligated to honor the current lease? In other words, will I, her former roommate, still be able to live in the apartment until the end of the lease?

Thank you very much for any responses.
