: : My girlfriend rented an apartment through a broker,
: : on Thursday last week. She gave them a security deposit and paid the brokers fee.
: : Yesterday, she called them and explained that she will not be taking
: : the apartment since she is not going to the original law school she planned
: : on going to. The broker stated that the lease was not countersigned as of yet.
: : The broker also indicated that she would get the security deposit back.
: : The broker then explained that she would not get any of the fee back.
: : What can she do? How can she get the fee back? By the way, the apartment was
: : not shown to her by the broker, it was simply an exclusive. She went and saw the
: : apartment with the doorman and simply signed through the broker.

The tenants Guide of the New York state attorney general's office:

Apartment Referral Agencies

Businesses that charge a fee for providing information about the location and availability of rental housing must be licensed by the state. The fees charged by these firms may not exceed one month's rent. When the information the firms provide does not result in a rental, the entire amount of any prepaid fee, less $15.00, must be returned to the tenant. Criminal prosecution for violations of this law may be brought by the Attorney General. (Real Property Law, Article 12-C)
