Very good question. DHCR are supposed to research market rents at any particular period through examining archive material but I doubt if they often get it right. : My landlord never filed an initial rent registration and I filed a "Fair Market Rent Appeal" many years later. The case is still pending with the DHCR. A year after my complaint my landlord filed the initial rent registration. After 8 years would the DHCR consider comparable rents from that period or would they go only on the RGB formula? Where would they get the comparable rents after so many years?
