: I just received the new MBR increase supposedly increasing rent at 3.8 percent. The form requires the MBR and MCR to be calculated based on the 12/97 rent figures. Are the 12/97 figures (being used as a base number for calculation of the new MBR) from the revoked order which was subject of the lawsuit filed by the landlords? or from the actual MBR increase order issued for and effective during 1996-1997 years (which order was never revoked)? My landlord appears to be using the figures from the revoked order.

The history of the lawsuit is complex (but there are articles in the
Met Council section) of the web site. We believe it should be on the
old figures (not the 33%). Get a clarification from DHCR, but also
call Met Council at 212-693-0550.
