This is sufficiently complex that I suggest the tenant consult
with a good tenant attorney. You may be referring to
the Multiple Dwelling Law as to the registration and requirement
to pay rent. Also, lack of DHCR registration might keep the
rent low. If there were no leases, the rent would not have gone up.
I don't think you would need to pay back rent to a new owner, but
there are exceptions. But in any case, they would need to go
through a civil court proceeding (not housing court) if you raise
the laches defense. You would also bring in that you paid
many expenses yourself. If this looks like it will get
sticky, you should get a lawyer.
