deposit dilemma!

Posted by Jana H. on July 24, 1998 at 16:41:05:

My former landlord wants to keep my security deposit for water damage from a leaky shower. He claims that he told me not to use the shower. I lived in the apartment for five years, and never heard anything about not using the shower, either from the landlord himself, or various family members who lived on the property. In fact, one family member fixed that shower for me, twice (he replaced the shower head, and also tightened the pipe fitting that had come loose). I did NOT have a written lease, which causes further complications. Do you think I stand a chance of getting my deposit back if I threaten small claims court? Should I be afraid of the landlord suing ME for shower damage? Any advice would be greatly appreciated! Thank you!
