I think it doesn't matter here as a Fair Market Appeal is not an overcharge.
Don't let DHCR convert it into an overcharge proceeding.

originally should have been until this situation is resolved?
Once the proceeding is over and a decision is rendered.
: 3) Can the landlord be responsible for treble damages?
Not on a Fair Market appeal, but the rent should be reduced to the
original rent.
Do some research on this, and look for the "Smitten" case -- on the
web site somewhere.
