Security deposit "paid in full"

Posted by Philip Kremer on April 06, 1998 at 13:55:11:

I finally got fed up with waiting for my security deposit, so I sued
my landlady. On the day before her "answer date", she returned
one third of my security deposit to me ($400): she had taken out
$800 for miscellaneous cleaning, repainting, etc.! Of course, I have
not dropped my suit.

On the check she sent me, she wrote "security deposit, paid in full".
I have been told that if I cash this check, then I will lose my court
case: to cash her check is to accept her offer. Question: should I
mail the check back to her, or should I hold onto it for evidence?
