I am in a similar situation as well. I have sent him 3 letters asking for payment back (and numerous phone calls). He is saying that until he finds a new buyer or renter, he can not give me back my deposit because of the holes from pictures in the wall that were not spackled. Personally, I know he does not have the money to give me until he gets a new lessee. I am starting the process in small claims court. It only costs $15 for them to issue a summons and a court date. Try doing that. I have a feeling once he sees the summons he will pay me. And your landlord will pay you. No one wants to go to court. The number is 212-791-6000.
