The increase set by the new law allowed for a 18%/20% increase
for one/two year leases, but DHCR, acting in their official
capacity as a landlord tool (Dan Margulies of CHIP, a landlord
group) reportedly called them up to get them to do this) said that
the existing RGB vacancy increases could be put on top of the
18/20 percent up through 9/30/97. This was a large bone of
contention and Assembly Speaker Shel Silver who put together this
law selling out half of tenant protections di not push the
issue. We don't know if any controlling litigation has come
on this issue although we've asked someone in a position to
know, so if we find out anything we'll report back.
