Landlord locked up my stuff

I'm in the process of moving between apartments. My lease doesn't expire until April and I have not been served an eviction notice. I was told by my landlady that I can't take out any more personal stuff until I give her a rent check for the month of December. I don't have the money right now but do intend to pay her. Meanwhile I want my stuff that she took out of my apartment and moved into my storage area after removing my storage area padlock and installing one of hers. The police say it's a civil matter and they wouldn't come out. How can the landlady legally keep my stuff without it being considered theft? I never gave her permission to enter my place. when I haven't been legally evicted? On top of that she's started to clean the place without my permission. Don't I still have the right to privacy? How do I go about getting my stuff back? The apartment is in upstate, NY. Thanks
