Repair and Deduct

Posted by Dan Dovdavany on December 02, 1997 at 01:39:40:

I have a question about a repair and deduct issue. Basically, one
of our shower handles was broken, and the cold water could not be turned
on. When the landlord's super told us that he couldn't come until 4 days
later, we had Roto-Rooter fix the handle. While the plumber was here, he
also replaced the hot water spindle which was causing a constant leak.

The repair cost about $250, and we took it out of the rent for
November. The landlord said that he would only pay for half, because
only one of the handles was actually an "emergency" repair. He tacked
on about $125 to December's rent.

Do we have to pay this amount, or can we simply send in our normal
rent and continue to fight with the landlord? Any advice you can give
would be appreciated.

Thanks.
