In Park Holding Company v. Eimick (look in Housing Court Decisions)
April 1996 the Appellate Term reversed the lower Court and found for the
landlord in such a case where the tenant obtained a "replacement" pet.
ALthough I don't have a citation readily available, I remember hearing
that the tenant finally won when the Appellate Division or the Court of
Appeals re-reversed in favor of the tenant.
