I wouldn't worry about it. The stipulation is a contract and the owner has to fulfill his/her part of it. The courts will uphold the stipulation as long as you have fulfilled your part of it. In other words, having a stipulation saying the owner must provide you with a lease is pretty much the same as having the lease (he/she can't not give you a lease).
