"Repair and Deduct" is not a statutory right in New York, but I have seen
it work in a few cases. It will depend on the facts of the case and the judge
you end up in front of. Be careful that you can document written and certified
mail requests to the landlord and that you've provided access. They will claim
they didn't know or that you denied access. Also good to get a violation if you
can and get photos if you can.
