I am pretty sure that it is not illegal to report you are paying late if you pay after the 1st. Why do you wait til after the first anyway? That is like sending in your VISA payment one day late ... which is also reported to credit agencies. The deal is before or by the (insert date). The 5th, 6th, 4th or whatever just represents a date where a penalty is applied.

My housemate tells me that in some states, notice is required (30 day, or on a rental agreement) before an owner can report. He is an attorney, so I imagine he is correct.

: We have just discovered that the leasing office has been putting marks on our credit report. They are untrue and as a result we will not get accepted into another apartment. Can they just put marks on your credit report without notice? The rent is d
ue on the 1st of the month, if the check is in their office on the 2nd is that grounds for putting in on your credit report even thought you are not charged a late fee until after the 5th? Where can I find information on certain laws prohibiting this beh
avior. for background history, we started to have problems with the office after I turned down a position with the company.
