After paying for copies of the court file, found out that even though
evidence was irrefutable that I had moved out on Jan. 26, l995 and that
the judge had stated restitution was mute, he then went on to sign a
writ of possession, even though everyone was aware I no longer lived in
the place. The sheriff posted the writ on the residence ( where no one
lived anymore) and that was suppose to serve as notice to me that the
writ had been given. Even though everyone knew my address, no one bothered
to send me proof of service by mail.
I asked for a postponement since the court date to UNCONFUSE the judge is
on Monday, May 19, however, I naturally was refused. I finally broke down
and hired an attorney. Not that I can afford one.
I then found out that this type of improper service
and unjust behavior by the judge and the property managers in this area
is common. And that court files are filled with correspondence to the
judge where the defendent is never made aware of these filings. Pretty
darn interesting, and a bit scary if you ask me. So, thanks for the help.
