: : Hi all. Any thoughts on how I can find answers to the following 2
: : questions (as they apply in NYC):
: : 1) If a tenant does not vacate immediately at the end of a lease is the
: : landlord required to pro-rate rent for the number of overstayed days or can rent be
: : charged for the entire month?
: : 2) If the tenant overstays the lease, how many days must pass (if any)
: : before the landlord can begin eviction proceedings?
: : Your opinion as well as a reference would be appreciated. Thanks.
: Arson is a form of eviction. Get a job you scum.
Hi...New here, and I certainly hope the previous response to your
questions isn't typical! Anyway, I wish I could be more helpful, but
I believe the place to find your answers would have to be determined
by the status of the apt.-- rent-controlled, stabilized, etc.
Re the second question, I have heard that failure to sign a new
lease is grounds for eviction, but I do know of people who have
remained in their apts.even after their lease expired. In my experience,
the landlord generally offers a new lease, with increase. I seem to
recall that a certain amount of time is given to sign, or vacate.
Not very helpful, I know:-), but at least not rude and moronic,
right? If I find answers for you, will re-post.
