security deposit/can't trust roommate

Posted by Deb on October 01, 1996 at 14:49:27:

I'm in sort of a weird situation and could really use some advice. When
I moved to New York I decided to sublet a room from a woman whose 2 roommates
had broken their lease. She claimed at the time that the building
management had "lost" the original 3-person lease, but gave her an oral
agreement to have me and another woman move in in place of the 2 women who
had left. The building management now claims that they never said any such
thing and that the 2 newcomers (I and another woman) have to move out by
December. I am sick to death of all the hassle, and although it is a
beautiful apartment, I am not bothering to fight this and will move out by
Dec. 1. The problem, however, is this: my two roommates are not leaving
until the end of December, and C.D., who is on the lease, "claims" that she
will mail me my portion of the security deposit at that time. C.D. has
lied repeatedly in the past about the lease, our situation with the
building management, etc. I see no reason to trust her on this issue, even
if she signs something agreeing to mail me the $700, and I can't afford to
take her to court over such a small amount. Any suggestions? I'd appreciate
it!
