Because DHCR is the method and forum in which the complaint is being brought. It could also be brougt in other forums (court) and not alleging violations of rent regulation. It could be based on contract law, on rent-gouging (which was used before rent regulation), on a variety of other grounds. They could seek declaratory relief, Real Property Law Article 6 (action, not a proceeding), etc. 99% of cases are in housing court or DHCR, but their not limited to these forums or grounds. These other grounds exist in other areas as well.

: How could you have the same problems in an unregulated unit which the name implies is unregulated,so it would be up to you what you charged and so the problem is due to the Rent stab laws.
