Withholding Rent and Ability of Landlords to Ruin Credit Rating

Posted by Adam on February 04, 2002 at 17:42:41:

To whomever is kind enough to help:
I have withheld one month's rent for lack of hot water. The problem is now fixed, after two months without hot water.
Question 1: Since our landlord has not agreed to what amount of rent should be deducted, am I allowed to continue withholding that one month's rent?
Question 2: What ability does my landlord have to affect my credit rating? Does the landlord need to go to court first to try to obtain the back rent? What if I believe I have the legal right to withhold rent, but without going to court the landlord hurts my credit rating -- what recourse do I have?

Thanks for your help.

David

P.S. My building is not rent stabilized or rent controlled.
