In his article in The New York Times, Jay Romano mentions that DHCR's regulation about overcharging a roommate don't apply to rent stabilized apartments in the rest of New York state.

And the separate regulations for rent controlled apartments in New York City and in the rest of New York state also contain no provisions about overcharging a roommate.

I hope this disparity has been raised by the lawyers who are in state Supreme Court challenging many of the changes DHCR has made.

And I certainly hope the tenant's attorney raised this disparity in housing court in RAM 1 L.L.C. v. Mazzola.

: Why would DHCR makes these changes only for rent stabilized and not rent controlled tenants?
