while that may be the legality, if you are still in the apartment, i wouldn't expect the landlord to make a whole-hearted attempt to rent the place to someone else. it's a lot tougher to rent out a place that's already occupied than an empty one. besides, if the landlord finds somebody to take your place, and then you can't move on time, then what? and, certainly the landlord will be painting, cleaning up, and fixing things, which he won't do while you're there.
