stop smoker from blowing it in?

I live in a rental above an old man who likes to smoke several cigars a day, usually starting around 8 a.m. I'm not opposed to him smoking in his own apartment, but he always sits next to an exhaust fan in his kitchen so that the smoke is blown out of his unit. The fan, coupled with the air currents in that windy corner of the building mean that the smoke ends up directly in our unit. We've tried everything- talking to him, installing our own fans, and buying an air purifier- but it doesn't help. We can only avoid it if all of the windows are closed, but that's a bad solution, particularly on hot summer days. Do we have any other recourse of action? Will we be forced to move if we complain to the management (both our apartment and his are rent stabilized and the management wants turn over)?
