Getting My Deposit Back--We Need A New Lease

I lived in an apartment on the Lower East Side of Manhattan (on Grand St.); 2nd floor of a three floor building above a bodega, one 4-bedroom apartment per floor. No rent regulation.

I moved out when the yearly lease (a written contract, signed by me and roomate "A") was up in JUNE. My other roommates "B" & "C" were going to take my part of the lease when they signed a new one (we've been living there for three years). I would get my deposit back, they would pay theirs.

Now. The landlord has been putting off signing a new lease with them. Roommate A has been calling him weekly since the summer. He puts it off, saying, "I'll get back to you in a few days."

She hasn't done any further action because she doesn't know what our rights are. What kind of legal action can/should we take or at least propose? And how do I get my deposit back?
